Texas Lawmakers Defy Governor Perry's Veto of Internet Sales Tax

Texas lawmakers are including an Internet sales tax provision in SB1, a revenue generating bill; defying Governor Rick Perry’s veto on the Internet sales tax bill last month. Governor Perry has stated that he strongly disagrees with the provision and wants it removed.

“I urge lawmakers to remove the Internet sales tax language from SB1.

The Fight Has Just Begun: The Internet Sales Tax

On Tuesday, Governor Rick Perry issued his first veto of the year, vetoing HB 2403, an Internet sales tax bill which FreedomWorks opposed. By vetoing HB 2403 Governor Perry has saved taxpayers and business alike from burdensome regulations and new taxes. In vetoing the legislation Perry cited that a key reason for his veto was that there was no consensus between lawmakers, tech experts, consumers and retailers.

A New Internet Sales Tax in Tennessee?

Tennessee lawmakers are pushing SB 0529, which would force Internet retail giant Amazon to collect state sales taxes that would be passed along to consumers. Amazon has threatened not to build planned distribution centers in Tennessee if the measures are put in place; they have already left Illinois, South Carolina and are threatening to leave Texas for similar legislation.

One Step Closer to an Internet Sales Tax in Texas

Last week, the Texas Legislature passed HB 2403, a bill aimed at taxing your internet purchases.  Currently, purchases made over the Internet are tax-free if the company does not have a physical presence within the state.  The bill expands the definition of a “nexus” or physical presence to include warehouses and distribution centers where online retailers distribute goods.
