Warrantless Wiretapping is Unconstitutional

Gennusa, et al. v. Canova, et al.: A non-incarcerated suspect and his attorney filed suit for violations of the Federal Wiretap Act and the 4th Amendment based on the warrantless recording of their conversations and the seizure of the written statement in the interview room of the St. Johns County Sheriff's Office. The District Court ruled in favor of the client and his attorney.

Decision

The Eleventh Circuit Court affirmed the decision in favor of the plaintiffs and remanded for further proceedings.
