Flashback: The Founders on the Necessity of a Free Press

With Congress attempting to define journalism again, it seems like a good time to revisit the whole "free press" thing. Understanding why the founders thought a free press was essential ultimately helps us determine whether federal overreach into protected liberties is appropriate. In 1799, James Madison explained:

In the Name of National Security

Of all tyrannies, a tyranny exercised for the good of its victims may be the most oppressive. -C.S. Lewis News breaks this morning that the NSA has the ability to monitor 75% of the nation's internet traffic at once. They can watch what 75% of Americans are doing at any one time online. Think on that for a moment.

NYPD's "Stop and Frisk" Found Unconstitutional, But Was This a Good Decision?

Yesterday, U.S. District Judge Shira Scheindlin ruled the New York Police Department's "stop and frisk" procedure unconstitutional, indicating it amounted to "racial profiling." Sounds like a solid win for the Fourth Amendment, right? Maybe not.As Mayor Bloomberg explained:As recently as 1990, New York City averaged more than six murders a day. Today, we’ve driven that down to less than one murder a day. If murder rates over the last 11 years had been the same as the previous 11 years, more than 7,300 people who today are alive would be dead.

Fourth Amendment Flasher Wins First Amendment Victory

Back in 2010 Aaron Tobey, now known as the "Fourth Amendment Flasher," protested TSA's unconstituional screening procedures. While waiting in the security line at Richmond International Airport, Tobey was referred to the full body (naked image) scanner. He declined the invasive scanner and opted for a pat-down.

The Other First Amendment Attack - Bible Studies

My Dad always told me everything is legal as long as you pay for it. Meaning of course, once you've paid for a permit you're exempt from laws those without a permit are bound to. Over the past few years, there have been numerous incidents of local governments harassing Bible study leaders who dare to host regular Bible studies in their homes.

Nothing to Hide, Something to Fear

Washington doesn’t have the right answers because they ask the wrong questions. Senator Lindsey Graham (R-SC) last month demonstrated a lack of understanding of America’s constitutionally protected rights when he nonchalantly explained he is “glad” that the government was spying upon Americans. Graham explained that if you have nothing to hide, you have nothing to fear. However, the American people have a lot to fear from politicians ask who defend tyranny above the right of the people.

Get Your Hands Out of My Purse, TSA

I suppose I should preface this by saying that I travel quite regularly. Spending time in airports, dealing with security and all the annoyances that come with modern day air travel are not Johnny-come-to-town occurances for this bright-eyed, redheaded gal. Sadly, I'm used to random bag searches at the TSA screening posts and the occasional blue-gloved molestation all in the name of "safety".
