While many Americans were recognizing the solemn events of the Memorial Day Weekend, the inside the beltway Sunday news shows rolled inexorably on. One US Senator used the opportunity to call question the wisdom of one of the most sacred of all liberties that are protected by the Constitution. In a poorly timed attack on the freedoms that the soldiers we honored fought and died for, Dick Durbin questioned the First Amendment protections enjoyed by bloggers and users of social media:

Obama's Recess Appointment Smackdown

Last year, during a recess while Congress was still in session, President Obama appointed three members to the National Labor Relations Board (NLRB). While it is Constitutional for a President to make recess appointments during a inter-cession recess, these appointments were made during a intra-session recess. It may sound like a minor detail, but it's not. These appointments to the NRLB, which enforce employee and employer rights, don’t fall under that category. Whoops.

Selective Rights

The Obama administration decided to pick a handful of fights that put our Bill of Rights at the center of the discussion. While I'm no fan of their liberty-crushing agenda, I'm always happy to have a discussion over the virtues of our founding documents and the rights they protect. There's one part of this discussion though, that needs to be addressed. There's a blanket argument bouncing its way around lefty spheres that goes something like this:

Forgotten Federalism

Most Americans are aware of very few of their Constitutional rights, or more accurately, Constitutional protections. As kids we try unsuccessfully to "plead the fifth" when mom questions us about the broken lamp and as teenagers, we love to remind our parents of our right to free speech. But aside from these few, there's an unfortunate ignorance about our other protections, in particular the tenth amendment.
