Legislation to Combat Costly Federal Regulations Will Be Reintroduced in the 115th Congress

Legislation that would go a long way toward restoring Article I of the Constitution and serve as a check on the regulatory state will be reintroduced when the 115th Congress begins on January 3. In a press release Wednesday, Rep. Doug Collins (R-Ga.) announced that he will sponsor the Regulations from the Executive in Need of Scrutiny (REINS) Act in the next Congress.

Restoring the Separation of Powers Through Congressional Action, Reversing Executive Orders and Regulations

While the 115th Congress begins on January 3 at noon, President Barack Obama will continue to serve in the White House until January 20, when President-elect Donald Trump takes office. The first 100 days of the incoming administration are expected to be incredibly busy. Obviously, the repeal of ObamaCare is at the top of the congressional to-do list, and action to begin this effort is expected to be immediate. Reining in the regulatory state is another item on which action is projected to be swift.

Last week, President-elect Trump tapped Oklahoma Attorney General Scott Pruitt to head the Environmental Protection Agency. In the past, Pruitt has sued the EPA, so it’s understandable that a quick analysis of the situation has left many people wary of this cabinet pick. Nonetheless, a closer investigation reveals that Pruitt is one of Trump’s best cabinet picks yet.

The Department of Labor recently finalized new standards to determine when salaried workers are eligible for overtime pay. While there is minimal evidence that these unilateral rule changes will achieve the aims claimed by the Obama administration, there will be clear harm to the liberty of employees who desire flexible work schedules, while imposing significant compliance costs on many employers. The Ozone Bureaucracy Complex: EPA Regulations That Can't Distinguish Between a National Park and City Harm the Poor Most

In October 2015, the EPA announced a new standard for ground-level ozone, tightening its stringent existing standard even more. It set the new standard at 70 parts per million (0.0070% of the atmosphere), a 9% decrease from the previous standard of 75 ppm established in 2008. Along with nearly 1000 counties nationwide that may not meet this new standard, one-third of all US counties, you’ll find at least 26 national parks. Does it seem ridiculous to you that the EPA has created a situation where some of the most rural and pristine areas of the United States could be lumping in the same category with the most densely-populated and industrialized? Well, then you don’t know the EPA.

The United States is in the midst of a constitutional crisis. The lines that clearly delineate the boundaries of the three branches of government, specifically, the executive and legislative branches, have become blurred. Presidents have claimed powers that far exceed what the framers intended, and Congress has been complicit by its failure to reestablish itself as the rightful and sole lawmaking authority.
