Congress Moves to Cancel Obama-Era Regulations Under the Congressional Review Act

Since the Congressional Review Act became law in 1996 through the 114th Congress, more than 120 resolutions of disapproval have been introduced to cancel regulations promulgated by federal agencies. The Congressional Review Act gives Congress 60 legislative days after a federal agency submits a rule for review. Between the 104th Congress and the 114th Congress, only one resolution of disapproval canceling a rule passed by both chambers of Congress and was signed into law.

On behalf of FreedomWorks’ activist community, I urge you to contact your representative and ask him or her to support resolutions of disapproval against costly regulations promulgated by federal agencies. The resolutions are aimed at regulations submitted for congressional review by the Department of the Interior, the Securities and Exchange Commission, Department of Defense, the General Services Administration, the National Aeronautics and Space Administration, and the Bureau of Land Management.

REINS Act Adds Teeth to the Congressional Review Act

On Thursday, the House of Representatives passed the Regulations from the Executive in Need of Scrutiny (REINS) Act, H.R. 26, by a vote of 237 to 187. This vote, which FreedomWorks will score on its 2017 Congressional Scorecard, marks the fourth consecutive Congress in which this legislation has passed the lower chamber.

Legislation to Combat Costly Federal Regulations Will Be Reintroduced in the 115th Congress

Legislation that would go a long way toward restoring Article I of the Constitution and serve as a check on the regulatory state will be reintroduced when the 115th Congress begins on January 3. In a press release Wednesday, Rep. Doug Collins (R-Ga.) announced that he will sponsor the Regulations from the Executive in Need of Scrutiny (REINS) Act in the next Congress.

Restoring the Separation of Powers Through Congressional Action, Reversing Executive Orders and Regulations

While the 115th Congress begins on January 3 at noon, President Barack Obama will continue to serve in the White House until January 20, when President-elect Donald Trump takes office. The first 100 days of the incoming administration are expected to be incredibly busy. Obviously, the repeal of ObamaCare is at the top of the congressional to-do list, and action to begin this effort is expected to be immediate. Reining in the regulatory state is another item on which action is projected to be swift.
