Only Taxpayers in State Exchanges are Eligible for Tax Credits

A key provision of the unpopular Patient Protection and Affordable Care Act means that employers only incur a mandate penalty when an employee takes advantage of subsidies in the state-run exchange.  A contemporaneous report from the Congressional Research Service confirms that interpretation.As we have noted, if there is no state-run exchange, there can be no subsidy to an employee and thus no penalty to an employer. Some are calling this problem a typo or drafting error, but it was no mere missing word. It was a strategic decision on the part of Congress. It means states should not implement an exchange.The Obama Administration, of course, is interpreting the law to mean what they want it to mean, not what it says it means by its plain wording and legislative history.

Every once in a while, the paper of record here in Oregon comes up with an interesting article that puts the hood up on our state government and gives it a going over. Granted, a regular maintenance plan should include far more frequent tune ups and oil changes, but when they remember to look at that little sticker in the corner of their windshield, they can be very diligent when they finally get in to the mechanic.

Full Repeal Part 1: Do Not Implement a PPACA Exchange

Freedom-loving Americans are more determined than ever to be rid of the misnamed Patient Protection and Affordable Care Act, knowing as we do that it will neither protect patients nor be in any way affordable.  FreedomWorks and other pro-freedom organizations have a simple Five Point Plan for full repeal. The first two of those points call for states to limit the Act's reach. It is important for activists and policy makers to understand these points and be able to explain them to others.First,  governors and legislators should decline to implement the Act's exchange in their state.The final four points are to decline to expand the state's Medicaid program, and for pro-repeal candidates to win the House, Senate, and Presidency in November. Then, of course, we will have to keep the pressure on our elected officials to pass a full repeal and proceed with reforms that champion patient centered health care and free market principles.

Our Favorite Bills to Replace ObamaCare

We need to repeal and replace ObamaCare. ObamaCare has to go -- all of it. But at FreedomWorks, we think full repeal is not enough. We also need to build a patient-centered, consumer-driven system, one that’s so successful and popular that no politician will ever again dare to take it over. What we don’t need is another massive, complicated top-down overhaul. Rather, we need a few targeted, sensible reforms that reduce costs and give patients more freedom and control.

PPACA Waivers and the Roberts Decision

The Obama administration granted more than 1600 waivers over compliance with parts of the Patient Protection Affordable Care Act. The Supreme Court ruling that the individual mandate is a tax will not affect the waivers, as they dealt with what kind of insurance people have, not whether they have it.  The ruling, and the waivers, point us directly to the disaster that awaits the country unless the PPACA is fully repealed.
