Due Process Act Will Protect Innocent People from Government Overreach

Rep. Jim Sensenbrenner (R-Wis.) introduced legislation Wednesday that would reform federal civil asset forfeiture laws, offering key protections to innocent people whose property is seized by the government. The Deterring Undue Enforcement by Protecting Rights of Citizens from Excessive Searches and Seizures Act (H.R. 5283), or Due Process Act, is the most significant, if not first, major reform of federal forfeiture laws since 2000, when Congress passed the Civil Asset Forfeiture Reform Act.

House Judiciary Committee in the Buckeye State Approves Civil Asset Forfeiture Reform

In a 9-4 bipartisan vote Tuesday, the Ohio House Judiciary Committee approved HB 347. The bill is sponsored by both Reps. Rob McColley (R-Napoleon) and Thomas Brinkman (R-Mt. Lookout). This advancement is a major step in progress for civil asset forfeiture reform goals but, more importantly, for Ohioans.

Recent Abuse of Forfeiture Law Highlights Need for Reform in Oklahoma

FreedomWorks has been a strong supporter of civil asset forfeiture reform. In the past we’ve put forward stories like that of Mandrel Stuart whose money was seized by the Fairfax County police, leading to the eventual loss of his restaurant. Another case in North Carolina saw Lyndon McClellan’s bank account wrongfully seized by the Internal Revenue Service.

Oklahoma and Georgia Governors Sign Conservative Justice Reform Bills into Law

This past Wednesday, Oklahoma Gov. Mary Fallin signed a package of justice reform bills into law, making the Sooner State the latest conservative state to adopt these “smart-on-crime” policies. That same day, Gov. Nathan Deal, on the other side of the country in Georgia, signed a smaller justice reform package into law, expanding on the state’s already impressive portfolio of justice reform initiatives. With the simultaneous adoption of these justice reform measures into law, conservative states like Oklahoma and Georgia are the pioneers in effective justice reform.
