Civil Asset Forfeiture Reform Unanimously Passes Florida House, Heads to Governor's Desk

The momentum for civil asset forfeiture reform continued Tuesday. The Florida House of Representatives unanimously passed SB 1044 less than a week after it passed the state Senate without opposition. SB 1044 requires law enforcement to make an arrest before property believed to be connected to a crime is seized and requires the government to present proof beyond a reasonable doubt before property can be forfeited to the state.

Florida Senate Unanimously Passes Law Enforcement-Backed Forfeiture Reforms

The Florida Senate, on Friday, unanimously passed legislation that would overhaul the state's civil asset forfeiture laws. Among the most notable parts of the legislation, SB 1044, are requirements that an arrest for a criminal offense is made when property is seized and increases the evidentiary standard the government must meet to "beyond a reasonable doubt" before seized property can be subjected to forfeiture. The bill also contains several reforms to forfeiture procedures and requires training for law enforcement on Florida forfeiture law.

Wyoming Governor Signs Civil Asset Forfeiture Reform

After vetoing a stronger version of asset forfeiture legislation, Wyoming Governor Matt Mead signed a bill that would still make significant improvements to the state’s forfeiture laws. The legislation was passed unanimously by both houses of the state legislature.

Support Civil Asset Forfeiture Reform in Virginia

Civil asset forfeiture laws throughout the country are in need of substantial reform in order to protect citizens’ basic rights. Asset forfeiture practice consistently tramples over the Fifth and Fourteenth Amendments to the U.S. Constitution by violating due process rights. Not only does this practice violate crucial provisions of the Bill of Rights, but it also violates Article 1, Section 11 of the Virginia Constitution which states, “That no person shall be deprived of his life, liberty, or property, without due process of law.”

Iowa Senator Wants to Protect Innocent People's Property from the Clutches of Forfeiture

Nearly a year after The Des Moines Register's groundbreaking investigative report on abuse of Iowa's civil asset forfeiture laws, legislation was introduced in the Iowa Senate to reform the state's forfeiture laws to protect innocent property owners from this pernicious form of government overreach. Unfortunately, it appears lawmakers want to further study the issue before they consider changes.
