An Article I Awakening: Congress Moves to Reclaim Its Full Constitutional Authority

Boldly wielding his pen and phone, President Obama has shamelessly used executive power to bypass those pesky Republican majorities in Congress. But these broad powers that he has used (and abused), the executive orders and the overbroad regulations, can in most respects be blamed on decades of Congressional atrophy. Which is why it is so encouraging that reasserting Congress’ constitutional authority has finally become a top-line issue in Washington D.C., with the launch of multiple major projects dedicated to the restoration of the full range of powers in Article I of the U.S. Constitution.

The Congress Strikes Back

Article I of the U.S. Constitution grants Congress the power to make law and to allocate how money is spent in the enforcement of those laws. The president’s role, in contrast, was envisioned by the founders as much more limited. They didn’t want a king, who could govern as he pleased without accountability to the people, and so they restricted his role to Commander in Chief of the military, with the power to make treaties only with the advice and consent of the Senate.

The Absurdity of Regulation

Combating the kraken-like reach of the regulatory state is one of FreedomWorks major initiatives for 2016. While the constitution grants Congress the power to legislate, recent administrations have chosen to circumvent this authority, using regulatory agencies instead to advance their agenda and create de facto laws. Regulations are especially dangerous to liberty, because those craft them are not elected and therefore not accountable to the people. For this reason, rules are often arbitrary, capricious, and selectively enforced. Sometimes, they are downright absurd.

Today marks the end of Copyright Week, an opportunity to examine the current system of copyright and consider opportunities to reform a system that many view as dysfunctional and a hindrance to innovation. Copyright Week was born in the wake of the massive digital protest against SOPA, the Stop Online Piracy Act, copyright reform legislation that would have done more harm than good. On the anniversary of the protests that saw many websites go dark to show their opposition to the legislation, Copyright Week provides a focus on the need to reform an outdated system that no longer serves its intended purpose.
