The IRS Blinks

Back in November, on the eve of Thanksgiving when they thought nobody would notice, the IRS surreptitiously announced its proposal of a new regulation that would severely limit the ability of tax exempt to groups to participate in the political process. The proposal was short on specifics, but the regulation would have given the IRS the power to narrowly define what constitutes “social welfare” and “political activity,” qualities it says organizations must exhibit in order to qualify for tax exempt status.

Ex-Mayor Michael Bloomberg has been the champion of this technique, aggressively pushing New Yorkers to stop smoking, stop eating trans fats and stop drinking sodas of 16 ounces or more.

The Growing Regulatory Burden, and the Challenge of Reform

According to the Office of Management and Budget, Americans currently spend 10 billion hours wading through federal paperwork requirements. In fact, in just one week in March, regulators added $1.4 billion to the regulatory burden, along with another 6.7 million hours of paperwork. And according to the National Federation of Independent Businesses, the largest problems for small businesses in February were regulation and red tape. Overall, the costs of regulation have become a significant problem. With the economy still enervated from the financial collapse of 2008, perhaps it is time to address the increasing regulatory burden, which can stifle the best laid schemes for economic growth.

The Dictatorial Senate

Back in November, when Harry Reid’s employed the nuclear option to allow judicial nominees to be confirmed with a simple majority vote, commentators on both sides of the political spectrum had plenty to say about the move. On the right, Reid was criticized for single-handedly uprooting years of Senate tradition and for robbing the minority party of their right to debate. On the left, Reid’s actions were praised as greasing the wheels of government to actually get things accomplished in the face of intractable Republican opposition. Supporters of Reid appealed to a sense of Democracy, arguing that majority should rule and that the sixty-vote threshold is an arcane relic of a different time.
