Obama on Course to Set a New Regulation Page Count Record in His Last Year

The Federal Register chronicles federal government’s rules, proposed rules, and public notices. It serves as a running tally of activity by the federal regulatory state. The record page count for the Federal Register is 81,405, set in 2010. In fact, six of the seven all time highest page counts have been recorded under the Obama administration. But the Obama administration is not done yet and in its last year it is on pace to set a new all-time record by the end of the year. This stands as a stark reminder of the massive expansion of the regulatory state under President Obama, an expansion which comes at the expense of the rights and freedoms of the American people.

The IRS Attacks Family-owned Businesses

The estate tax, applied to assets of someone when they die, represents a tiny portion of federal revenue. But for farms and businesses at risk of being caught by this death tax, the effects can be huge. If a business or farm is valuable enough to be ensnared by the estate tax, passing on this asset built and developed over a lifetime, or across generations, becomes extraordinarily difficult and costly, sometimes even impossible. But apparently the Internal Revenue Service does not think this situation is bad enough and has proposed new regulations which would make passing on a business to your children even more difficult.

Rule 41 Violates Fourth Amendment

The Advisory Committee on Criminal Rules for the Judicial Conference of the United States has proposed an amendment to Rule 41. While these rules are typically procedural changes, the proposed changes in Rule 41 are actually a substantive policy change that provides federal law enforcement sweeping new powers to remotely search and seize electronic storage media.

Yahoo Case Highlights Trouble for Privacy Rights

Last year, Yahoo received a court order from the Justice Department (who obtained it from the Foreign Intelligence Surveillance Court) obligating Yahoo to scan all of its users’ emails for specific information, which has not been disclosed. We do know some of that search involved finding traces of malware. By modifying a standard spam filter, Yahoo was able to search through all of its users’ emails, not just individual accounts, in real time. Yahoo claims to have since discontinued this practice.

Time for the Ohio Senate to Pass Forfeiture Reform

A new poll from the Coalition For Public Safety shows a majority of Ohio voters support justice reform. The sentiment is shared by Ohioans of all stripes, including a significant number of those in the Statehouse, as evidenced by the support and passage in the Ohio House of House Bill 347 -- a bill that would end the practice of seizing private property from individuals who are suspected (but not convicted) of having taken part in a crime. The bill has yet to pass the Ohio Senate.
