Omnibus Doesn’t Include Prohibition on DOJ’s Property Grab

The Consolidated Appropriations Act, H.R. 1625, is packed full of legislative priorities for leadership and other items to get enough votes for passage. Most of what was negotiated and slipped into the Consolidated Appropriations Act, known as the “omnibus,” behind closed doors is bad for taxpayers or just bad policy. Unfortunately, amendments that were previously passed by the House to prevent the Department of Justice from ramping up its use of civil asset forfeiture were not included in the bill.

Asset Forfeiture Reform Signed into Law in Nebraska

This past Tuesday, Nebraska made history when Governor Pete Ricketts signed LB 1106 into law, completely reforming the state’s asset forfeiture system. In doing so, Nebraska has become the 10th state to require a conviction before property can be seized. What’s more, the reforms are so sweeping that Nebraska has become the third state, following New Mexico and North Carolina, to essentially disband its civil asset forfeiture system, a great boon for innocent citizens and private property.

Justice Department Restarts Program Used to Take People's Property Without Due Process

The Department of Justice, on Monday, restarted the Equitable Sharing Program, which allows federal law enforcement agencies to coordinate with their state and local counterparts to pursue forfeiture of seized money and property under federal civil asset forfeiture laws. The program, which distributes up to 80 percent of the proceeds from these forfeitures to the state and local law enforcement agencies, was suspended in December because of budget constraints. Payments owed were deferred.

Now Is the Time to Act on Federal Civil Asset Forfeiture Reform

Santa Claus came a little earlier for those who have been urging for changes to federal civil asset forfeiture laws. The Department of Justice sent a letter to state and local law enforcement agencies notifying them that it would defer equitable sharing payments due to budget constraints. The step is temporary, as the Department of Justice wants to resume the program at a later time.

Court orders return of an innocent man's money, but the federal government isn't letting it go

Straughn Gorman was driving on Interstate 80 in Elko County, Nevada in January 2013 when he was pulled over by a state patrolman for driving too slowly in the passing lane. The patrolman asked to search Gorman's recreational vehicle, but Gorman, a resident of Hawaii, did not consent. Though the patrolman let him go without so much as a warning or traffic citation, it appears he arranged for an Elko County sheriff's deputy who had a drug-sniffing dog to pull him over.

Unlikely allies in the California Legislature urge colleagues to protect innocent people from abuse of federal forfeiture law

UPDATE: The Assembly Public Safety Committee unanimously approved SB 443 on Tuesday, though it was amended. The bill will have to go through the Appropriations Committee before it heads to the Assembly for a final vote. Because the bill was amended in committee, it will have to go back to the Senate for approval.
