Guilty Until Proven Innocent

The United States Government seized more from private citizens than burglars in 2014. Current federal laws regarding civil asset forfeiture are overstepping private property rights under the Fifth Amendment of the US Constitution. Under the Fifth Amendment it is the obligation of government to provide evidence against private individuals whereas current civil asset forfeiture laws require private citizens to prove innocence. Civil Asset Forfeiture, where government confiscation is acceptable if it’s in the name of protecting the United States against drug lords by taking away private property.

On behalf of our activist community, I urge you to contact your senators and representatives and ask them to cosponsor the Fifth Amendment Integrity Restoration (FAIR) Act, S. 642 and H.R. 1555, introduced by Sen. Rand Paul (R-Ky.) and Rep. Tim Walberg (R-Mich.). The FAIR Act would reform federal civil asset forfeiture laws to increase the evidentiary standard needed to subject property to permanent seizure and restore the presumption of innocence in federal civil forfeiture proceedings.

Senator Rand Paul on Justice Reform

Last Friday Senator Rand Paul spoke at Bowie State University about the need to reform our justice system. He spoke of the need to reform a system where 2 million American children have fathers in prison, leading to a breakdown of the American family. He spoke of the need to reform a system that too often prevents individuals from gaining employment after their release from prison and instead turns them over to the welfare state. Most importantly, he spoke of real proposals to implement the necessary changes, not vague hopes or dreams.

House Hearing on Civil Forfeiture

Imagine this, you are moving from Michigan to California to start a new life and your dad gave you $2,500 to help you start out on your feet. While driving through Nevada you get pulled over by a deputy sheriff and he asks you how much money you have on you. You think to yourself, “that’s a strange question, but I’ve done nothing wrong and have nothing to hide,” so you tell the officer you have $2,500 from your dad.
