Michigan Voters Overwhelmingly Support Changes to Forfeiture Laws

In 1988, John Bennis was convicted of indecency in the state of Michigan for engaging with a prostitute in his car. He was fined a mere $250 for the incident, but his car was seized through a civil court order under a public nuisance claim. Bennis’s wife, Tina Bennis, was also a legal owner of the vehicle, but despite her shared interest in the car, the state denied her rights as partial owner.

Michigan police endorse reforms to protect innocent property owners from government overreach

Abuse of civil asset forfeiture laws can harm law enforcement's vital relationships with communities, especially at a time when their activities are coming under heightened scrutiny. Realizing this, the Michigan Association of Police Organizations has endorsed a package of eight reform bills working through the Michigan Legislature that would overhaul the state's civil asset forfeiture laws to provide more protections for innocent property owners.

GOP-controlled Michigan House passes a comprehensive civil asset forfeiture reform package

On Thursday, the Michigan House of Representatives passed a bipartisan package of eight bills that would overhaul the state's civil asset forfeiture laws to offer more protections for innocent property owners. The Wolverine State is just the latest to advance reforms that curtail this pernicious brand of government overreach.

Republicans in the Michigan Legislature make private property protections a priority

Michigan, like so many other states, has seen significant abuse of civil asset forfeiture laws by law enforcement. The Detroit Free Press found that law enforcement seized property and cash worth at least $24.3 million in 2013. Many of the property owners were never charged with, let alone convicted of, a crime.
