Emergency Declaration Debate Presents an Opportunity for Article I

Following the Senate’s passage yesterday of the joint resolution to disapprove of President Trump’s recent emergency declaration to use existing funds to construct a barrier along some portions of our southern border, it is clear that some in Congress are finally picking up an important message. Congress has to put a stop to and reverse course on its slow-but-steady ceding of its constitutional powers to the executive branch. On everything from trade and regulation to war and now the power of the purse, the executive branch and the president are much more powerful than was intended as outlined in Article I of the Constitution.

On behalf of FreedomWorks’ activist community, I urge you to contact your representative and ask him or her to cosponsor the Separation of Powers Restoration Act, H.R. 76. Introduced by Rep. John Ratcliffe (R-Texas), the Separation of Powers Restoration Act would reduce the influence of the federal bureaucrats in the regulatory state by ending the Chevron deference established by the Supreme Court.

Restoring the Separation of Powers Through Congressional Action, Reversing Executive Orders and Regulations

While the 115th Congress begins on January 3 at noon, President Barack Obama will continue to serve in the White House until January 20, when President-elect Donald Trump takes office. The first 100 days of the incoming administration are expected to be incredibly busy. Obviously, the repeal of ObamaCare is at the top of the congressional to-do list, and action to begin this effort is expected to be immediate. Reining in the regulatory state is another item on which action is projected to be swift.

Conservatives give a lot of lip service to the Constitution, but too few actually read it or know what it says. While many focus on the admittedly important Bill of Rights, the meat of the Constitution outlines the basic functions of government, including the checks and balances designed to keep tyranny from America's door. It is respect for these checks and balances that has driven some lawmakers to launch the Article I Project, an initiative aimed at restoring the separation of powers and using Congress to rein in the excesses of the executive branch.
