Fury Over School Regulations: It’s the Department of Education, Stupid!

Yesterday's proposed rules on school accountability are yet another reminder that it’s time for federal bureaucrats at the Department of Education to get their hands out of our education system. In its latest power-grab, the department seeks to enact top-down measures that would remove authority from the hands of teachers, school districts, and state government. The regulation would impose Education Department-mandated accountability measures promulgating federal government oversight over student and school achievement.

Department of Education Policing Universities with Student Aid Enforcement Unit

The Department of Education, in its latest move to enlarge the ever-expanding education bureaucracy, has announced plans to create a Student Aid Enforcement Unit to better respond to “predatory institutional activity.” The Student Aid Enforcement Unit was established following an investigation of prohibited tactics in student recruiting. It will apply to any school receiving federal aid.

Regulatory Dark Matter Leaves Congress in the Dark

In an April 19 report, Why Congress Must End Regulation by Guidance Document, the Competitive Enterprise Institute (CEI) warns us about the enormous impact of federal agencies’ sub-regulatory “guidance” documents, including a big negative effect on the economy and job creators. These guidelines, which can be as informal as a bulletin or press release, do not undergo formal notice and comment rulemaking procedures and are not legally binding in a strict sense, as the House Oversight Committee has noted. Nonetheless, they are used to make major policy decisions and, according to Senator Pat Roberts (R-Kan.), are “often as effective as regulations in changing behavior due to the weight agencies and courts give them.”

It’s not duck season, it’s not rabbit season, it’s Testing Season. As hundreds of thousands of students opt out of Common Core testing, teachers are weighing the professional risks of speaking out against this testing. Instead of fixing the problems with Common Core and its myriad of regulations, Education Department bureaucrats have resorted to shooting the messengers – our nation’s teachers. Perhaps Testing Season should be renamed Hunting Season.

"Head Start" Initiative Crashes and Burns

Clinging to the hope that a model for a universal preschool program could run effectively, the U.S. Department of Health and Human Services created a project known as Head Start CARES in order to put this concept to the test. The purpose of this initiative was to put to the test three "evidence-based" ways of helping children in lower income communities develop a love of learning, which would eventually grow their academic prowess and help create a rise in the number of high school graduates in impoverished communities throughout the country. Sadly, Head Start has proved to be a failure to launch. According to Heritage Foundation research fellow David Muhlhausen, PH.D. "Experimental evaluations released in 2014 and 2015 by the U.S. Department of Health and Human Services found that enhanced Head Start CARES demonstration programs had little to no effect."

Obama’s Private Army: Militarizing the Federal Agencies

Currently there are 73 federal agencies that have full-time armed officers with arresting authority. According to a 2008 report by the Department of Justice, there were 120,000 full-time law enforcement officers working for federal agencies and 24 different federal agencies employed at least 250 full-time officers. Federal agencies with at least 250 full-time officers included the U.S. Forest Service, U.S. Mint, U.S. Postal Inspection Service and the Veterans Health Administration.
