Uncovering Misconduct at the EPA

On Wednesday, the House Committee on Oversight and Government Reform held a hearing to examine employee misconduct at the EPA. Misconduct has continued at the EPA despite repeated reform efforts and multiple hearings. Chairman Jason Chaffetz (R-Utah) opened the hearing by calling the EPA “one of the most toxic places in the federal government to work.” That is a big claim, and one that should alarm conservatives and libertarians who consciously worry about corruption, protectionism, and bureaucracy in the federal government.

Congressional Review Act Resolutions Signify an Important Stand Against EPA Overreach

Earlier this week, Republicans in both the House and the Senate filed resolutions under the Congressional Review Act aimed at the EPA’s greenhouse gas rules for new and existing power plants. These resolutions, if successful, would block President Obama and the EPA’s executive actions, and would only need the majority votes to do so. Although the measures would still be vulnerable to an essentially guaranteed presidential veto, they still send an important message to the President and the EPA on behalf of many states, industries, and businesses.

A Small Victory Against EPA Overreach

On Friday, the EPA was dealt another loss by a federal judge as the U.S. Court of Appeals for the 6th Circuit authorized a national stay against the Waters of the United States (WOTUS) rule under the Clean Water Act. This comes after a federal judge in North Dakota had already granted a preliminary injunction against the EPA in August, only a few hours before the rule was about to be implemented.
