The Supreme Court decided that the Environmental Protection Agency failed to adequately consider the cost of its mercury regulation for power plants.

On the surface, the rule seems to give the beleaguered coal industry a break but in reality, the decision will have little impact.

Although the regulation remains in place while the U.S. Court of Appeals for the D.C. Circuit reviews the decision, utility companies have already closed numerous coal-fired power units to comply with the regulation that was issued in 2011.

It’s expected that the D.C. Circuit will keep the regulation but require the EPA to justify the cost of limiting mercury emissions from power plants.
