FreedomWorks Urges Congress to Codify IRS “Structuring” Changes into Law

Following a report that the Internal Revenue Service (IRS) will return nearly $30,000 it wrongfully seized from Randy Sowers, a dairy creamery owner in Maryland, FreedomWorks Director of Communications Jason Pye commented:

“While we’re glad to see that Randy Sowers and his family are finally getting back the money they were intimidated into giving up from the IRS, we believe that more needs to be done to ensure that situations like this never happen again. There have already been some administrative policy changes related to so-called ‘structuring’ cases, but Congress must act to ensure that no future administration can reverse them unilaterally.”

“Congress, sooner rather than later, must address this form of government overreach. The Due Process Act, which has already moved out of committee, would codify these administrative changes into law and protect innocent people from wrongful civil asset forfeiture.”

In May, FreedomWorks released a letter of support for the Due Process Act, H.R. 5283. This legislation would reform federal forfeiture laws by raising the evidentiary standard required in such cases, putting the burden of proof on the government and addressing procedural shortfalls in current law.
