DOJ Offers a Mixed Bag Update on First Step Act Implementation

On Monday, the Department of Justice (DOJ) put out a release outlining its intentions for and the status of the implementation of the First Step Act. Signed into law on December 21, 2018, the First Step Act is a comprehensive overhaul of the federal prison system, run by the Bureau of Prisons. Certainly, it is encouraging to see the department taking affirmative steps toward implementing the law.

DOJ Overtly Attempts to Undermine President Trump's Prison Reform Agenda

Over the past several months, there has a been a campaign against the FIRST STEP Act, H.R. 5682, waged by a handful of reactionaries whose mindset is better suited for the 1980s. Ways and Means Republicans Demand Answers from DOJ on Refusal to Return Wrongfully Seized Money

Republicans on the House Ways and Means Committee want to know why the Department of Justice (DOJ) has denied petitions by Americans whose money was seized by the Internal Revenue Service (IRS). The seized money was subject to federal civil asset forfeiture hearings in which the individual from whom the money was taken had to prove that it wasn’t connected to any wrongdoing.

States Lead the Way on Criminal Justice Reform

Over the past several months, Attorney General Jeff Sessions has taken a step back on federal justice reform efforts, regressing to purportedly “tough on crime” stances. From advising increased penalties for nonviolent offenders to more recently promising an increase in the use of civil asset forfeiture by the federal government, Sessions has been doing everything in his power to give the Department of Justice (DOJ)’s full support to 80s-era policies from which many conservatives have abandoned in favor of evidenced-based practices that reduce recidivism and enhance public safety.

Support the Fifth Amendment Integrity Restoration (FAIR) Act, S. 642 and H.R. 1555

On behalf of our activist community, I urge you to contact your senators and representatives and ask them to cosponsor the Fifth Amendment Integrity Restoration (FAIR) Act, S. 642 and H.R. 1555, introduced by Sen. Rand Paul (R-Ky.) and Rep. Tim Walberg (R-Mich.). The FAIR Act would reform federal civil asset forfeiture laws to increase the evidentiary standard needed to subject property to permanent seizure and restore the presumption of innocence in federal civil forfeiture proceedings.
