Starve the Bureaucratic Beast: Support A Pure Leahy-Lee Amendment

The last time legislators updated the Electronic Communication Privacy Act (ECPA) was when Facebook CEO Mark Zuckerberg was a toddler. With new technological innovation and new privacy concerns, Congress must cooperate to bring the laws into the 21st Century. Reforming the ECPA is necessary to guarantee our Constitutional protection against warrantless digital searches and seizures. The answer is the Leahy Lee-Amendment.

The House is expected to vote today on the Fourth Amendment. The outcome is in doubt. How far we've drifted from the letter of the Constitution and the spirit of liberty!

Fourth Amendment Flasher Wins First Amendment Victory

Back in 2010 Aaron Tobey, now known as the "Fourth Amendment Flasher," protested TSA's unconstituional screening procedures. While waiting in the security line at Richmond International Airport, Tobey was referred to the full body (naked image) scanner. He declined the invasive scanner and opted for a pat-down.

Planes, Trains, and Automobiles: The TSA’s Misapplication of the Precautionary Principle

In the wake of tragedy of 9-11, the American people feared terrorists would take away their freedom. The greatest threat to freedom was the voluntary surrender of freedom for the sake of government-provided “protection”. This “precautionary principle” has been used by Big Brother to say “governments should implement regulatory measures to prevent or restrict actions that raise even conjectural threats of harm to human[s].” In essence, this principle claims overprotection causes little to no harm.

Get Your Hands Out of My Purse, TSA

I suppose I should preface this by saying that I travel quite regularly. Spending time in airports, dealing with security and all the annoyances that come with modern day air travel are not Johnny-come-to-town occurances for this bright-eyed, redheaded gal. Sadly, I'm used to random bag searches at the TSA screening posts and the occasional blue-gloved molestation all in the name of "safety".

NSA Domestic Spying: A History of Abuse

Whistleblower Edward Snowden brought warrantless wiretapping to the forefront of national conversation by exposing the National Security Agency surveillance of the American people. While  many  Americans  are outraged at the NSA’s unconstitutional actions, few realize the extensive history of NSA’s spying policies. Since President Truman established the NSA in 1952, the agency has grown in both power and technological capabilities, enabling them to spy upon Americans without consent or probable cause.

The NSA and Fourth Amendment: Reliving 1984

The National Security Agency (NSA) used a top secret court order to collect telephone records on millions of Americans without their consent. The order demanded Verizon to provide records on an "ongoing, daily basis" to the federal government on calls both within the United States and between the United States and other countries.

The Supreme Court Rules on DNA Collection

This is still America, right? We still have a Constitution and a Bill of Rights, correct? Lately, it sure doesn’t seem like it. It seems like we are constantly hearing new stories of our rights being under attack here in America. This week, it’s the Fourth Amendment which is being systematically destroyed.

Letter in Support of the Fourth Amendment Preservation and Protection Act of 2013

Dear FreedomWorks member,  As one of our millions of FreedomWorks members nationwide, I urge you to contact your Senators and urge them to cosponsor S. 1037, the Fourth Amendment Preservation and Protection Act of 2013. Introduced by Sen. Rand Paul (R-KY), the bill would extend Fourth Amendment guarantees to electronic communications. The Fourth Amendment Preservation and Protection Act is needed to protect against the violations of our Fourth Amendment rights online.
