When Life Hands You Lemons, the Government Will Regulate How You Use Them

In the summer of 2015, Andria and Zoey Green decided that they wanted to surprise their father with a trip to the local water park for Father’s Day. As young entrepreneurs, the girls, ages 7 and 8, decided to raise the $105 they needed by selling cold lemonade to passersby on a scorching Texas day. At the highly competitive price point of 50 cents a glass, they made more than $25 in an hour. The girl’s business was thriving, until the Overton Police decided to join the party.

Pennsylvania's Failed Experiment in Flexible Pricing

Although it received practically no attention at the time, the Tax Cuts and Jobs Act of 2017 included a small but significant provision tailored towards temporarily relieving the heavy tax burden placed on small American breweries that make up about 95 percent of the marketplace. This seemingly innocuous provision lowered the federal excise tax, cutting small domestic brewers tax burden in half.

Allowing STELAR to Expire Will Bring Regulatory and Market Parity

There are few markets that have changed more in the last 30 years than video distribution. When Congress passed the Satellite Home Viewer Act in 1988, it intended to favor the fledging home satellite industry so it could grow to compete with cable. Today, the satellite industry is a multibillion-dollar industry that has close to a 30 percent share of the paid television market and, in addition to cable providers, there is a robust and flourishing over-the-top marketplace. Yet vestiges of this legislation – it’s most recent iteration is known as STELAR – persist to favor the home satellite industry at least until it is scheduled to sunset this year on December 31.
