Louisiana Judge's Common Core Ruling Serves as Judicial Activism

Providing an excellent example of baseless judicial activism is Judge Todd Hernandez from the 19th Judicial District Court in Louisiana. In a decision starved of legal grounding and reasoning, Judge Hernandez prohibited Gov. Bobby Jindal from halting the implementation of the Common Core educational standards with executive orders BJ 2014-6 and BJ 2014-7 and the Office of Contractual Review’s retraction of the contract with DRC (Data Recognition Corporation) to assist with the introduction of Common Core.

The Long Arm of the Law: Government Demands Access to Microsoft’s Servers in Ireland

In a troubling expansion of government snooping, a New York judge ruled Thursday that Microsoft has to open its servers to federal investigators. What’s concerning in this case is that the servers in question are not on U.S. soil—they are located in Ireland. In pursuit of information from Microsoft, the federal government pulled Microsoft into court to argue over the government's power to act through a warrant to access information stored on the company’s overseas servers.

The Case That Could Doom ObamaCare Moves One Step Closer to the Supreme Court

The U.S. Court of Appeals for the District of Columbia made a crucial ruling today that should make ObamaCare supporters nervous. After hearing the case Halbig v. Burwell (formerly Halbig v. Sebelius), a three-judge panel ruled 2-1 that the federal government cannot legally distribute insurance premium subsidies or enforce the individual or employer mandates in states which have not created their own health insurance exchange. The case will likely go before the full D.C. Circuit Court, which would be the last stop before a likely journey to the U.S. Supreme Court.
