Time for the Ohio Senate to Pass Forfeiture Reform

A new poll from the Coalition For Public Safety shows a majority of Ohio voters support justice reform. The sentiment is shared by Ohioans of all stripes, including a significant number of those in the Statehouse, as evidenced by the support and passage in the Ohio House of House Bill 347 -- a bill that would end the practice of seizing private property from individuals who are suspected (but not convicted) of having taken part in a crime. The bill has yet to pass the Ohio Senate.

Pennsylvania on the Cusp of Passing Forfeiture Reform

Current Pennsylvania law allows police to seize property without due process or conviction of a crime. Civil asset forfeiture legally incentivizes policing for profit by allowing the police to keep 100 percent of the proceeds from seizures. This practice creates a conflict of interest for the authorities who benefit monetarily from seizing property.

Property Rights: A Valued American Ideal

‘Property rights’ appears more times in The Constitution than any other right. The Fifth Amendment to the United States Constitution declares that no person “… be deprived of life, liberty, or property, without due process of law…” The ideas backed by the Fifth Amendment are the fundamental aspects that ensure The United States to be an arsenal for freedom; those who have had their individual freedoms comprised by the state take refuge in these ideals.

The Government Routinely Invites Itself to Travel with You

Recent information and a USA Today report indicates that the Drug Enforcement Administration (“DEA”) has been mining Americans’ travel records to profile individuals and intercept potential drug traffickers. Over the past decade, DEA teams acquired over $209 million in cash from at least 5200 travelers at 15 of the country’s busiest airports. The justification for these seizures is the same used for most other civil asset forfeiture scenarios: use of money in the form of cash is linked to drug trafficking.

Prominent Conservatives and Their Take on Justice Reform

The Republican Party has for a long time been perceived as the party that is not sympathetic to criminal justice reform. The common opinion is that those who favor the legalization of marijuana and other drugs are usually associated with the Democratic Party. This same rationale has been applied to justice reform as well. However, things have been changing now as the Republican Party continues a stronger and more public push to promote conservative ideals within our justice system.
