Issue Analysis

Issue Brief: Joe Biden and the Supremes

Despite attempts by some to change the paradigm, the size of the Supreme Court has remained at nine since 1869. This tradition has survived Reconstruction, industrialization, the Great Depression, two World Wars, the Cold War, multiple impeachment trials, and thousands of political spats. Yet, it appears that the progressive movement currently sweeping the left wing of American political life may finally be the death knell of this long-standing practice.

In his seminal graphic novel, The Watchmen, author Alan Moore presents a near future dystopia where law enforcement, unable to protect the citizenry, is supplanted by crime-fighting vigilantes. Support the Keep Nine Constitutional Amendment, H.J. Res. 11

On behalf of our activist community, I urge you to contact your representative and ask him or her to cosponsor the proposed amendment to the Constitution, H.J.Res. 11, to require that the number of Supreme Court be limited to nine. Introduced by Rep. Dusty Johnson (R-S.D.), the proposed constitutional amendment would prevent congressional Democrats from playing politics with the Supreme Court.

The Left Is Trying to Change the Definition of "Court-Packing"

Over the weekend, Sam Berger of the Center for American Progress tried to make the claim that Republicans had packed federal courts with conservative nominees by confirming circuit court judges. Sen. Dick Durbin (D-Ill.) made a similar statement on Sunday during an appearance on Meet the Press. “The American people have watched the Republicans packing the court for the past three and a half years,” he said, “and they brag about it.”
