Wait, the government can take YOUR property without convicting you of a crime?

Civil asset forfeiture laws allow the government to seize private property, even when citizens’ haven't been charged with a crime. These laws are a glaring violation of our 5th Amendment right to property and due process. In these cases, law enforcement must only provide probable cause in order to seize property, which, in practice, includes even the most dubious pieces of evidence.

Imagine this, you are moving from Michigan to California to start a new life and your dad gave you $2,500 to help you start out on your feet. While driving through Nevada you get pulled over by a deputy sheriff and he asks you how much money you have on you. You think to yourself, “that’s a strange question, but I’ve done nothing wrong and have nothing to hide,” so you tell the officer you have $2,500 from your dad. Introduced by Senators Mike Lee (R-Utah) and Dick Durbin (D-Ill.) in the Senate (S. 502) and by Congressmen Raúl Labrador (R-Id.) and Bobby Scott (D-Va.) in the House (H.R. 920), the Smarter Sentencing Act would “focus limited federal resources on the most serious offenders.”

The United States has the highest incarceration rate in the developed world, with enough people in prison to populate a small country. Preserving law and order is obvious a priority in any civilized society, but it’s hard to see how locking away a significant portion of the population can be considered a good thing, especially when so many are currently spending years behind bars for non-violent offenses.
