FreedomWorks Joins Conservative Groups to File Amicus Brief in SCOTUS Internet Sales Tax Case

Washington, DC- FreedomWorks is proud to join a coalition of 5 conservative groups in filing an amicus brief in the Supreme Court case South Dakota v. Wayfair, which will address the internet sales tax on April 17.

South Dakota is attempting a power grab that would allow the state to tax businesses with physical locations beyond state borders. This would be a clear violation of our constitutional protection against “taxation without representation,” and cripple the ability of online businesses to thrive in a global marketplace.

FreedomWorks Vice President of Legislative Affairs Jason Pye commented:

"Our Founding Fathers revolted over taxes passed by the British Parliament to which colonists had no representation. Now, more than 200 years later, we are having this fight in the digital space. Taxation without representation is still tyranny, whether it’s done on brick and mortar, or over the internet.”

“The Supreme Court got it right in the Quill decision, and the internet has flourished as a result. A reversal would undermine our constitutional rights, create tax compliance headaches for small internet-based businesses, and feed state and local governments’ addictions to spending.”

“We’re proud to fight this fight with our conservative allies, and hope the Court keeps the precedent established in Quill in place."

Other groups involved in the brief include: Institute for Policy Innovation, Americans for Prosperity, Freedom Partners Chamber of Commerce, and the National Taxpayers Union Foundation.
