FreedomWorks supports the ECPA Modernization Act of 2017 by Senators Mike Lee and Patrick Leahy to protect the Fourth Amendment rights of every American by amending the Electronic Communications Privacy Act of 1986. This outdated law was written before most people even knew what the word internet meant, and well before the world of cloud-computing and online data storage. This legislation is in dire need of an upgrade, and Sens. Lee and Leahy should be applauded for taking the lead on this important issue.

In Government We Antitrust

The American economy produces roughly $18 trillion worth of goods and services every year as firms compete to provide consumers the goods and services they demand. But over time, the government has come to play a much larger role in the economy, imposing regulations that cost the economy over $1.9 trillion annually. Unfortunately for consumers, these regulations are often put in place to limit competition and restrict entry into the marketplace by firms trying to avoid the gales of creative destruction. And now, there is a renewed interest in weaponized antitrust, with America’s tech giants under renewed scrutiny at home and abroad. The culprits are competitors seeking to increase their market share through government intervention. Unfortunately, for consumers, this typically means higher prices and reduced choices in the marketplace.

Perpetually increasing prescription drug prices ravage everyday Americans. Specifically, name-brand prices outpace inflation by about 50%, largely due to government-protected market power. A beacon of hope for reducing drug prices are the generic and biosimilar drug industries, which produces existing brand drugs and biologics drugs through distinctly cheaper methods. But big Pharma doesn’t want competition, so it does everything it can to block generic and biosimilar innovation. The CREATES Act, H.R. 2212, solves a loophole commonly abused by big pharmaceutical companies for unlawful market advantages in the emerging generics and biosimilars markets.
