Congress needs to reclaim its proper role as the chief legislator. This means leading the way on tough issues, instead of waiting for regulatory agencies to deal with them first. Despite the radical overreach at the administrative level, the consistent inaction by congressional leaders has precipitated this crisis. Congress must also use its powers under the Congressional Review Act to repeal harmful or outdated regulations and pass new legislation allowing for more thorough reviews of executive branch rulemakings. The Senate must also ensure in its confirmation proceedings that every Cabinet nominee respects the proper distribution of power, and that Article I places lawmaking authority with Congress.
